In order to create sustainable health systems, many countries are introducing ways to prioritize health services underpinned by a process of health technology assessment. While this approach requires technical judgments of clinical effectiveness and cost-effectiveness, these are embedded in a wider set of social (societal) value judgments, including fairness, responsiveness to need, non-discrimination and obligations of accountability and transparency. Implementing controversial decisions faces legal, political and public challenge. To help generate acceptance for the need for health prioritization and the resulting (...) decisions, the purpose of this paper is to develop a novel way of encouraging key stakeholders, especially patients and the public, to become involved in the prioritization process. In this article I examine the consequences of the dominance of intuitive thinking in moral judging and deciding for the role of moral reasoning in moral education. I argue that evidence for the reliability of moral intuitions is lacking. We cannot determine when we can trust our intuitive moral judgements. Deliberate and critical reasoning is needed, but it cannot replace intuitive thinking. Following Robin Hogarth, I argue that intuitive judgements can be improved. The expertise model for moral development, proposed (...) by Hubert and Stuart Dreyfus, not only teaches us how we acquire intuitive moral judgements, it also shows the interconnectedness of intuitive thinking and deliberate reasoning. Analysing the expertise model in more detail, I show that it cannot do justice to the importance of reasoning skills. Reasoning skills are needed because we expect people to be able to argue for their standpoints. I conclude that moral education should not only aim at improving intuitive moral judgements, but also at acquiring reasoning skills. (shrink)

The complex problems facing developing countries have often been attributed to the tendency of their people to maintain traditional beliefs and practices. Many contemporary philosophers have criticized traditional thought for failing to match the levels of efficiency and effectiveness achieved by modern science. However, other contemporary philosophers have suggested that modern science embodies tendencies that are as likely to exacerbate as relieve the problems of the developing world. I conclude that philosophers must be as wary of modern practices and beliefs (...) as they are of traditional practices and beliefs. Modernity rather than tradition is undoubtably a principal source of Africa's problems. ZieglerFollowing the publication of Bram Stoker's Dracula in 1897, vampire narratives proliferated in Britain and the United States.1 While many twentieth century short stories, novels, plays, and films in both countries depart from Dracula in various ways, it is our impression that that workand its close derivatives retain pride of place in the popular imagination. Yet Dracula was but (...) one of several well-known vampire stories published in English during the nineteenth century, and scholars deem certain of the other tales to be of literary merit.In noting that, we raise this question: What is it about the plot and the characterization of vampires in Dracula that make it the most famous example of vampires in English fiction? Why, in particular, has it been more influential than Le Fanu's Carmilla which preceded it in time and is of equal or perhaps greater literary distinction?2 We address that question, and by doing so we hope to gain some insight into the attraction and persistence of vampire tales across time and cultures.We begin by sketching our approach to conceptualizing the category "vampire." Nina Auerbach, a Professor of English at the University of Pennsylvania, writes that "There is no such creature as 'The Vampire'; there are only vampires."3 That declaration is in keeping with her demonstration that in nineteenth and twentieth century British and American vampire novels, short stories, plays, and films, vampires vary greatly in behavior, in apparent motivation, and in cultural significance. Different social orders and different culturally supported sensibilities [End Page 218] and sensitivities, she persuasively argues, find expression in different sorts of vampires.We deem Auerbach's literary nominalism preferable to an essentialism that would govern vampiric class inclusion by insisting on some conjunction of necessary features or conditions. At the same time, however, we think that there is a better way of allowing for differences in conceptualizing vampires and in understanding their multi-faceted significance in British and American imaginings of the last two centuries. That way combines the recognition of family resemblances with insights derived from prototype theory in the cognitive sciences.A family resemblance approach can be quite liberal in what it includes as instantiations of the category "vampire." It can encompass not only such familiar (albeit different) figures as Ruthven, Varney, Carmilla, Dracula, and Lestat, but also others, including so-called "psychic vampires," who flourish not by sucking blood but by draining vitality, will, and even experience from their victims. Some may ask, does this not create a category that is so promiscuous in what it includes as to render the category analytically useless? No, we reply, once you couple family resemblance with insights from prototype theory.Prototype theory, narrowly described, attempts to account for "prototype effects." These "effects" are differences in the judgments that people render about how well different instances of a category exemplify the category. Thus, for instance, some people may judge apples and oranges to be clearer or better exemplars of the category "fruit" than olives. Similarly, some may judge robins and sparrows to be clearer or better exemplars of the category "bird" than penguins. Judgments can be explicitly given, or they can be inferred from the order of examples that people give or from their responses to lists of examples furnished by others. Prototype theorists call the adjudged clearest or "best" examples of categories "prototypes" or "the most prototypical exemplars."4 This approach celebrates centrality and periphery rather than essence and boundary in conceptualizing categories.5 It allows that some instantiations of a category may be deemed more central to the category than others. Thus in the case of vampires, Dracula is more central to the category than, say, the shape-shifting space alien who extracts salt from victims in an episode of Star Trek, First Generation. Auerbach recognizes that centrality when she refers to "Dracula's dominance in our century" (p. 111). In lieu of an abstract, here is a brief excerpt of the content:Reply to Russell's letter of 16 May 1960 by Albert Shalom EDITORIAL NOTE To illustrate a list ofrecent acquisitions in Russell (Summer 1981), we printed in facsimile Russell's letter of 16 May 1960 to Professor Albert Shalom concerning the interpretation of Wittgenstein's Tractatus LogicoPhilosophicus. The correspondence between Russell and Shalom began when Shalom wrote on I May 1960 asking whether Russell had the time and inclination to (...) read a translation of a lecture which Shalom had given the previous December in Paris. The paper was entitled "The Metaphysical Thinking Underlying Wittgenstein's Tractatus". Shalom had received "different and even contradictory appraisals" of his paper, and he very much wanted to have Russell's opinion of it. Close to the age ofninety, Russell was entering a hectic period in his life in which he worked assiduouslyfor the Campaign for Nuclear Disarmament. He had published three books in 1959 and had produced prefaces and introductions for other people. As usual, he was besieged with mail including numerous requests to read unsolicited manuscripts sent to him quite regularly. Yet he had managed to answer correspondence in a very personal way. In November 1959, he had been involved in a controversy regarding the refusal ofthe editor of Mind to review Ernest Gellner's Words and Things, a book which attacked the then prevalent philosophy of linguistic analysis and for which Russell had written the introduction. In the early months of1960, he took time out from his usual writing on the nuclear threat to reply to several articles devoted to his theory of descriptions and his ethical theory in the journal Philosophy. Russell's reply (4 May 1960) to Shalom's first letter states: "Thank you for your letter ofMay I. I shall be interested to see your paper on Wittgenstein's Tractatus, but, as I am very busy, it may be some time before I can read it carefully." On 8 May Shalom wrote back in appreciation enclosing his paper and an offprint of an article, "Qu'est-ce qu'un concept?", Revue internationale dephilosophie, 50 (1959): I-IS. The main objection raised against his paper, Shalom admitted, was that Wittgenstein was not concerned with problems of epistemology at the time of his writing the Tractatus. Nonetheless, Shalom felt that the "picture theory" of reality implies an epistemology, and he was unable to see a fallacy in his paper: "Perhaps the fact that I'm not a logician has something to do with the matter. Ifyou could enlighten me on this point I should be most grateful to you." 45 28th April 1982. 46 Russell winter 1982-83 Russell's letter of 16 May followed. On 25 May Shalom challenged Russell's interpretation. Far /rom underestimating the notion of structure, Shalom claimed that he had emphasized the notion as the key to understanding the Tractatus. "In fact, my main point is that Wittgenstein's analyses of various concepts are unintelligible unless understood as arguments in terms of the dominating idea ofstructure or form. And that is what I understand as a metaphysical argument." Shalom went on to say that his interest in any philosopher was to try to discover the chief concepts employed in the philosopher's analysis and to examine the manner in which the analysis was performed. For this reason, the later Wittgenstein was not devoid ofinterest. In a postscript, he asked Russell whether he would be in London in July ofthat year, and ifso, whether a meeting was possible. Russell replied on 18June as follows: "Thank you for your letter ofMay 25. I am sorry that at present my time and thought are so occupied with matters very remote from those with whichyour letter deals that I cannot offeryou a reasoned reply. Unfortunately, I do not expect to be in London in July so that I am afraid a meeting will hardly be possible." On 14 Shalom requested the return of his paper, and Russell complied on 19 July. Quotation has been much studied in philosophy. Given that quotation allows one to diagonalize out of any grammar, there have been comparatively few attempts within the linguistic literature to develop an account within a formal linguistic theory. Nonetheless, given the ubiquity of quotation in natural language, linguists need to explicate the formal mechanisms it employs. The central claim of this paper is that once one assumes a dialogical perspective on language such as provided by the KoS (KoS is not an (...) acronym, despite emphasizing a Konversationally Oriented Semantics) framework, formalized in a rich type theory like Type Theory with Records, much of the mystery evaporates. In particular, one can utilize as denotations for quotative constructions entities that are independently motivated for dialogue processing—utterance types and locutionary propositions, Austinian propositions about speech events. In the introduction to his sermon, the writer of Hebrews suggests that God’s revelation unfolded from his so-called ‘Old Testament’ revelation to his ‘New Testament’ revelation in his Son (Heb. 1:1–2a). By doing a thorough exegesis of Hebrews 1:1–2a, the author’s view of such an unfolding revelation is confirmed. From this conclusion, certain hermeneutical implications of the unfolding of God’s revelation are drawn for believers and scholars today. Among others, it is determined that God’s revelation is progressive, that his revelation (...) in his Son is superior, climactic and final, and that God’s final revelation in his Son can only be understood within the context of his Old Testament revelation, and vice versa.Keywords: Hebrews; Hebrews 1:1-2a; unfolding; revelation; hermeneutics. Cryonics is the preservation of legally dead human bodies at the temperature of liquid nitrogen in the hope that future technologies will be able to revive them. In philosophical debates surrounding this practice, arguments often focus on prudential implications of cryopreservation, or moral arguments on a societal level. In this paper, we claim that this debate is incomplete, since it does not take into account a significant relational concern about cryonics. Specifically, we argue that attention should be paid to the (...) potential implications of cryopreservation for the mourning processes of surviving loved ones. Cryopreservation increases the likelihood of disruption of the practical and mental tasks involved in a successful mourning process, which can negatively impact survivors of the cryopreserved patient. To illustrate my argument, we will draw on a case study from the 2019 documentaryHope Frozen. We aim to introduce this concern, in order to gain a more complete view on the potential implications of cryopreservation. (shrink)

Abstract:Therapeutic misconception (TM)—when clinical research participants fail to adequately grasp the difference between participating in a clinical trial and receiving ordinary clinical care—has long been recognized as a significant problem in consent to clinical trials. We suggest that TM does not primarily reflect inadequate disclosure or participants’ incompetence. Instead, TM arises from divergent primary cognitive frames. The researchers’ frame places the clinical trial in the context of scientific designs for assessing intervention efficacy. In contrast, most participants have a cognitive frame (...) that is personal and focused primarily on their medical problems. To illustrate this, we draw on interview material from both clinical researchers and participants in clinical trials. We suggest that reducing TM requires encouraging subjects to adjust their frame, not just add information to their existing frame. What is necessary is ascientific reframingof participation in a clinical trial. (shrink)

We introduce a new understanding of deontic modals that we callobligations as weakest permissions. We argue for its philosophical plausibility, study its expressive power in neighborhood models, provide a complete Hilbert-style axiom system for it and show that it can be extended and applied to practical norms in decision and game theory.

Thomas Hobbes has recently been cast as one of the forefathers of political realism. This article evaluates his place in the realist tradition by focusing on three key themes: the priority of legitimacy over justice, the relation between ethics and politics, and the place of imagination in politics. The thread uniting these themes is the importance Hobbes placed on achieving a moral consensus around peaceful coexistence, a point which distances him from realists who view the two as competing goals of (...) politics. The article maintains that only a qualified version of the autonomy of the political position can be attributed to Hobbes, while arguing more generally that attending to the relation between ethics and politics is central to assessing his liberal credentials from a realist perspective. Against the prevalent reading of Hobbes as a hypothetical contract theorist, the article proceeds to show that the place of consent in his theory is better understood as part of his wider goal of transforming the imagination of his audience: a goal which is animated by concerns that realists share. We argue that the inference from dispositional essentialism about a property (in the broadest sense) to the metaphysical necessity of laws involving it is invalid. Let strict dispositional essentialism be any view according to which any given property’s dispositional character is precisely the same across all possible worlds. Clearly, any version of strict dispositional essentialism rules out worlds with different laws involving that property. Permissive dispositional essentialism is committed to a property’s identity being tied to its dispositional profile or causal (...) role, yet is compatible with moderate interworld variation in a property’s dispositional profile. We provide such a model of dispositional essentialism about a property and metaphysical contingency of the laws involving it. (shrink)

Les critiques qui l’accablent aujourd’hui sont en grande partie liées aux ambiguïtés et aux impasses qu’engendre l’enchevêtrement, pas toujours très clair, des pouvoirs actuellement exercés par le Parlement, la Commission et le Conseil. Une autre partie de la critique est plus tranchante : elle récuse le principe même de la construction européenne en l’accusant d’instituer (...) un déni de démocratie. Lavoisier defined an element as a chemicalsubstance that cannot be decomposed usingcurrent analytical methods. Mendeleev saw anelement as a substance composed of atoms of thesame atomic weight. These `definitions' doquite different things: Lavoisier'sdistinguishes the elements from the compounds,so that the elements may form the basis of acompositional nomenclature; Mendeleev's offersa criterion of sameness and difference forelemental substances, while Lavoisier's doesnot. In this paper I explore the historical andtheoretical background to each proposal.Lavoisier's and Mendeleev's explicitconceptions of elementhood differed from eachother, and (...) from the official IUPAC definitionof `element' of the 1920s. However, Lavoisierand Mendeleev both subscribed to – andemployed – a deeper notion of a chemicalelement as the component of compound substancesthat (i) can survive chemical change, and (ii)explains the chemical behaviour of itscompounds. The first philosophers paved the way for the work of Plato and Aristotle - and hence for the whole of Western thought. Aristotle said that philosophy begins with wonder, and the first Western philosophers developed theories of the world which express simultaneously their sense of wonder and their intuition that the world should be comprehensible. But their enterprise was by no means limited to this proto-scientific task. Through, for instance, Heraclitus' enigmatic sayings, the poetry of Parmenides and Empedocles, and Zeno's (...) paradoxes, the Western world was introduced to metaphysics, rationalist theology, ethics, and logic, by thinkers who often seem to be mystics or shamans as much as philosophers or scientists in the modern mould. And out of the Sophists' reflections on human beings and their place in the world arose and interest in language, and in political, moral, and social philosophy. This volume contains a translation of all the most important fragments of the Presocratics and Sophists, and of the most informative testimonia from ancient sources, supplemented by lucid commentary. This article analyzes the relationship between the ideas of cruelty and injustice in Judith Shklar’s political theory. Shklar’s The Faces of Injustice is sometimes read as an instantiation of the liberalism of fear, which regards cruelty and the fear that it inspires as the summum malum. I challenge this interpretation and instead argue that her account of injustice should be read independently of her commitment to the liberalism of fear. In doing so, I show how her exploration of the faces (...) of injustice—especially the importance she accords to passive injustice and the sense of injustice—raises important challenges for the liberal case for putting cruelty first. Although democratic attitudes and institutions constitute the best available remedy for the sense of injustice, on Shklar’s account, those who focus too much on the requirements of democratic citizenship risk treating injustice as a greater evil than cruelty, which could, in turn, facilitate cruelty and undermine liberal democracy. I conclude by suggesting that the republican-inspired theory of citizenship from The Faces of Injustice, which Shklar outlines in response to the problem of passive injustice, reflects a distinct strand of her political theory that goes beyond the more familiar defense of law-bound constitutional government associated with the liberalism of fear. Globalization has been one of the most hotly contested phenomena of the past two decades. It has been a primary attractor of books, articles, and heated debate, just as postmodernism was the most fashionable and debated topic of the 1980s. A wide and diverse range of social theorists have argued that today's world is organized by accelerating globalization, which is strengthening the dominance of a world capitalist economic system, supplanting the primacy of the nation-state by transnational corporations and organizations, and (...) eroding local cultures and traditions through a global culture. Contemporary theorists from a wide range of political and theoretical positions are converging on the position that globalization is a distinguishing trend of the present moment, but there are hot debates concerning its nature, effects, and future.2 Moreover, advocates of a postmodern break in history argue that developments in transnational capitalism are producing a new global historical configuration of post- Fordism, or postmodernism as an emergent cultural logic of capitalism (Harvey 1989; Soja 1989; Jameson 1991; and Gottdiener 1995). Others define the emergent global economy and culture as a "network society" grounded in new communications and information technology (Castells 1996, 1997, and 1998). For its defenders, globalization marks the triumph of capitalism and its market economy (see apologists such as Fukuyama 1992 and Friedman 1999 who perceive this process as positive), while its critics portray globalization as negative (see, for example, Mander and Goldsmith 1996; Eisenstein 1998; and Robins and Webster 1999). Some theorists see the emergence of a new transnational ruling elite and the universalization of consumerism (Sklair 2001), while others stress global fragmentation of “the clash of civilizations” (Huntington 1996). Driving “post” discourses into novel realms of theory and politics, Hardt and Negri (2000) present the emergence of “Empire” as producing evolving forms of sovereignty, economy, culture, and political struggle that unleash an unforeseeable and unpredictable flow of novelties, surprises, and upheavals.
